SECTION1. Chapter 8, Section 8-1.5, Kaua'i County Code 1987, as amended, is hereby amended by amending the definition of "Developed Campgrounds," "Organized Recreation Camps," and "Undeveloped Campground" as follows:
"Developed Campgrounds" means land or premises designed to be used, let, or rented for [temporary] compensation, monetary or otherwise, for transient occupancy by campers traveling by automobile or otherwise and which contain such facilities as tent sites, bathrooms or other sanitary facilities, piped water installations, and parking areas, but not including mobile home parks. Each individual tent camping site offers a campsite that may have permanent footings, platforms, and/or private restroom facilities. Developed campgrounds may include facilities for the temporary placement of camp trailers and camping vehicles which are utilized for non-permanent residential uses [at no more than six (6) vehicles per acre].

November 3, 2021
- Bill 2838 (11/3 ver) as available at the 11/3/21 County Council Public Hearing. Members of the public all testified in support of Bill 2838. Council members did not discuss the Bill as the hearing was for gathering testimony from the community. At the conclusion of the hearing the County Council unanimously voted to forward the bill to the County Council's Planning Committee for review, the next step to bringing it to the Mayor for his final signature.
November 17, 2021
- The County Council's Planning Committee passed Bill 2838 without any changes to the text.
December 1, 2021
- The County Council passed Bill 2838. The bill goes immediately to Mayor Kawakami who we anticipate will sign the bill into law.

Kaua‘i Mayor Derek Kawakami signed Bill 2838 into law.
View the final signed Bill 2838 document which creates zoning Ordinance 1105 with supporting signature pages by the County Council and Mayor Kawakami. Ordinance 1105 changes zoning laws so they prohibit Developed Campgrounds (ie. glamping sites) on zoned Open Space and zoned Agricultural land throughout the entire beautiful Island of Kauai.
This stops Starwood Capital Group's attempt to build 50 Glamping tent sites on Princeville's Makai Golf Courses which are all designated zoned Open Space. The SOS Hui has fought against this proposed development since the summer of 2020 when Starwood Capital Group first publicly announced their intentions.
